HostRadar hosting service agreement, acceptable use policy, and legal terms governing your use of our services.

By purchasing, accessing, or using HostRadar's web hosting services, you agree to be bound by these Terms and Conditions. Please read them carefully. If you do not agree with any part of these terms, do not use our services.
1. Service Agreement
These Terms and Conditions ("Agreement") constitute a legal agreement between you ("Customer," "Client," "You") and HostRadar ("Company," "We," "Us," "Our") regarding your use of web hosting services, domain registration, and related products offered through hostradar.net. This Agreement becomes effective upon your purchase or use of any HostRadar service and continues for the duration of your service subscription.
HostRadar reserves the right to modify these terms at any time. Material changes will be communicated via email to the address on file. Continued use of services after such modifications constitutes acceptance of the updated terms. Customers who disagree with modifications may cancel their service pursuant to the cancellation terms outlined herein.
2. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials (username, password, cPanel access, billing area login). You agree to immediately notify HostRadar of any unauthorized use of your account or any security breach. HostRadar will not be liable for any loss or damage arising from your failure to maintain adequate security.
You are solely responsible for all content, data, files, scripts, and materials uploaded to or transmitted through your hosting account. You must ensure you have all necessary rights, licenses, and permissions for any content you host. You agree to comply with all applicable laws, regulations, and third-party rights including but not limited to intellectual property laws, privacy laws, export control laws, and obscenity laws.
You agree to provide accurate, current, and complete information during account registration and to maintain and promptly update such information to keep it accurate, current, and complete. Providing false or misleading information may result in immediate account suspension or termination.
3. Acceptable Use Policy
HostRadar hosting services may not be used for any illegal, harmful, or offensive activities. Prohibited uses include but are not limited to:
- Illegal Content: Hosting or distributing content that violates Pakistani law, international law, or the laws of any jurisdiction from which you access the service. This includes pirated software, copyright-infringing material, illegal pornography, or content promoting illegal activities.
- Spam and Unsolicited Communications: Sending unsolicited bulk email (spam), operating email lists without proper opt-in procedures, or using our services to harvest email addresses. Zero tolerance policy applies to spam activities.
- Malicious Activities: Hosting malware, viruses, trojans, ransomware, phishing sites, or engaging in hacking attempts. Operating botnet command-and-control infrastructure, proxy services for malicious purposes, or participating in distributed denial-of-service (DDoS) attacks against any target.
- Resource Abuse: Executing scripts or processes that consume excessive server resources (CPU, RAM, disk I/O) in a manner that degrades service for other customers. Running cryptocurrency miners, launching intensive brute-force attacks, or operating high-frequency automated scripts without prior approval.
- Network Abuse: Port scanning, vulnerability scanning of third-party systems, operating open proxies or VPN services (except as specifically authorized), IP spoofing, or any activity designed to compromise network security.
- Adult Content: While legal adult content is permitted under certain conditions, you must implement age verification, comply with all applicable regulations, and maintain content within community standards. Child sexual abuse material (CSAM) is strictly prohibited and will result in immediate law enforcement notification, account termination, and legal prosecution.
- Harmful Content: Content promoting violence, terrorism, hate speech, harassment, or discrimination. Content encouraging self-harm, illegal drug use, or weapons trafficking.
Violation of this Acceptable Use Policy may result in immediate account suspension without prior notice, permanent termination, forfeiture of all fees paid, and cooperation with law enforcement agencies when illegal activities are identified. HostRadar reserves the sole discretion to determine whether content or activity violates this policy.
4. Billing and Payment Terms
All hosting services are billed in advance on a monthly, quarterly, semi-annual, or annual basis as selected during purchase. Payment is due immediately upon service activation or renewal. We accept JazzCash, Easypaisa, bank transfers, and credit/debit cards as detailed on our website.
Failure to make timely payment may result in service suspension. Accounts suspended for non-payment will be held for 7 days, after which all data may be permanently deleted. HostRadar is not responsible for data loss due to non-payment. A reactivation fee may apply to restore suspended accounts.
All fees are stated in Pakistani Rupees (PKR) unless otherwise specified. Prices are subject to change with 30 days' advance notice for existing customers. New pricing applies to renewals after the notice period. Domain registration and renewal fees are separate from hosting fees and are non-refundable as they incur immediate registry costs.
You authorize HostRadar to charge your selected payment method for all applicable fees including setup fees, monthly or annual hosting fees, overage charges (if applicable), domain registration or renewal fees, and any additional services you purchase. Disputed charges must be reported within 30 days via our billing support team.
5. Service Levels and Uptime
HostRadar strives to provide 99.9% uptime for hosting services. This uptime guarantee excludes scheduled maintenance (announced at least 48 hours in advance), force majeure events, issues caused by customer configurations or scripts, third-party application failures, DNS propagation delays, DDoS attacks, and upstream network provider failures beyond our control.
Uptime is measured monthly from server-side monitoring. In the event we fail to meet the 99.9% uptime commitment due to infrastructure failures attributable to HostRadar, eligible customers may request service credits as outlined in our Service Level Agreement. Service credits represent your sole remedy for uptime failures. Credits must be requested within 7 days of the downtime incident via support ticket with specific dates and times.
HostRadar does not guarantee performance metrics beyond uptime. While we maintain high-performance infrastructure, website speed and responsiveness depend on numerous factors including your application code, database optimization, content delivery methods, and visitor geographic location. We provide guidance and tools to optimize performance but make no guarantees regarding specific load times or performance benchmarks.
6. Data Backup and Security
HostRadar provides automated daily backups via JetBackup as a courtesy. We retain 7 daily snapshots allowing one-click restoration through cPanel. However, backups are provided on a best-effort basis without guarantee. HostRadar is not liable for backup failures, data corruption, or inability to restore data from backups.
You are solely responsible for maintaining your own backup copies of all data, content, and configurations. For mission-critical data, implement additional backup solutions including off-site backups, version control systems, or third-party backup services. HostRadar strongly recommends maintaining at least three copies of critical data in geographically separate locations.
While HostRadar implements security measures including SSL certificates, firewalls, malware scanning, and intrusion detection, no system is completely secure. You are responsible for securing your own applications, implementing strong passwords, keeping software updated, and following security best practices. HostRadar is not liable for security breaches resulting from vulnerabilities in your code, outdated software, weak passwords, or social engineering attacks targeting your accounts.
7. Service Modifications and Termination
HostRadar reserves the right to modify, suspend, or discontinue any service or feature at any time with or without notice. We will make reasonable efforts to provide advance notice of material service changes that negatively impact existing customers. Service modifications do not entitle customers to refunds unless the modification fundamentally eliminates core agreed-upon functionality.
You may cancel your hosting service at any time by submitting a cancellation request through your client area or via email to our billing department. Cancellations take effect at the end of your current billing period. No refunds are provided for partial months except as covered by our 30-day money-back guarantee for new customers (see Refund Policy for details).
HostRadar may immediately suspend or terminate your service without notice if: (a) you violate this Agreement or our Acceptable Use Policy, (b) your account is used for illegal activities, (c) your activities threaten the security or performance of our infrastructure, (d) payment is delinquent beyond the grace period, or (e) we receive legal demands requiring account termination. Upon termination, your data may be immediately deleted. HostRadar is not obligated to provide data exports or backups for terminated accounts.
8. Intellectual Property Rights
All intellectual property rights in HostRadar's website, control panel interfaces, documentation, logos, trademarks, and proprietary software remain the exclusive property of HostRadar or our licensors. Your hosting service grants you a limited, non-exclusive, non-transferable license to access and use these materials solely for managing your hosting account. You may not copy, modify, distribute, reverse engineer, or create derivative works from any HostRadar proprietary materials.
You retain all intellectual property rights to content you upload to your hosting account. By hosting content with HostRadar, you grant us a limited license to store, transmit, display, and backup your content solely as necessary to provide hosting services. We do not claim ownership of your content and will not use your content for purposes beyond service provision except as required by law or this Agreement.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOSTRADAR'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO HOSTRADAR IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY.
IN NO EVENT SHALL HOSTRADAR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, EVEN IF HOSTRADAR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
HostRadar provides services "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. HostRadar does not warrant that services will be uninterrupted, error-free, or completely secure. You assume all risks associated with using our services for your specific purposes.
10. Indemnification
You agree to indemnify, defend, and hold harmless HostRadar, its officers, directors, employees, agents, partners, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) arising out of or related to: (a) your use or misuse of our services, (b) your violation of this Agreement, (c) your violation of any third-party rights including intellectual property, privacy, or publicity rights, (d) content you host or transmit through our services, or (e) any illegal activities conducted through your account.
This indemnification obligation survives termination of this Agreement and your use of HostRadar services. HostRadar reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.
11. Dispute Resolution and Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions. Any disputes arising out of or relating to this Agreement or HostRadar services shall be subject to the exclusive jurisdiction of the courts located in Pakistan.
Before initiating formal legal proceedings, you agree to first attempt to resolve disputes informally by contacting our support team. Many disputes can be resolved quickly through direct communication. If informal resolution fails, both parties agree to pursue mediation before resorting to litigation, except for claims involving intellectual property infringement, confidentiality breaches, or urgent injunctive relief requirements.
12. General Provisions
Entire Agreement: This Agreement, together with our Privacy Policy, Refund Policy, and Service Level Agreement, constitutes the entire agreement between you and HostRadar regarding hosting services and supersedes all prior agreements, understandings, or representations.
Severability: If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
No Waiver: HostRadar's failure to enforce any provision of this Agreement shall not constitute a waiver of that provision or any other provision. No waiver shall be effective unless made in writing and signed by an authorized HostRadar representative.
Assignment: You may not assign or transfer this Agreement or any rights hereunder without HostRadar's prior written consent. HostRadar may assign this Agreement to any successor entity in connection with a merger, acquisition, corporate reorganization, or sale of substantially all assets.
Notices: All notices related to this Agreement must be sent to HostRadar via email to info@hostradar.net or via registered mail to our official business address. Notices to you will be sent to the email address associated with your account and are deemed received 24 hours after transmission.
